IT/ITeS Employees Centre (ITEC) has met the Additional Labour Commissioner of the state of Karnataka to discuss the possibilities of legal support against illegal layoffs happening across the industry under the disguise of “forceful resignation”.
According to the Labour Laws, Companies that employs more than 100 employees need to obtain approval from the Labour department inorder to execute layoffs. Additional Labour Commissioner has confirmed that, none of the IT companies in Karnataka has intimated the Labour Department about the layoffs and hence they are violating the labour laws by forcing employees to resign.
ITEC urges all the victimized employees to refuse to resign if asked to do so by the company and insist on the proper procedure, as per law, to be followed. According to Additional Labour Commissioner, employees can file complaint under “refusal of employment” if there is an attempt by the employer to indulge in forceful resignation. ITEC demands urgent intervention of the government to this matter and request to take stricter actions against the companies who violates the laws of the land. Employees need not panic, but unite together to fight the injustice.
